These terms apply to your use of draftalive.com and to every order you place with us. DraftAlive is operated by Pennantry Inc., a Texas corporation ("we", "us"). By using the site or placing an order, you agree to these terms.

1. Using the site

You must be at least 18, or have a parent's or guardian's permission, to place an order. You agree not to misuse the site, interfere with its operation, or use it for anything unlawful.

2. Orders and prices

  • Prices are in U.S. dollars and depend on quantity and embroidery placements. The price shown at checkout is the price you pay.
  • Your order is accepted when we confirm it by email. We may decline or cancel an order, with a full refund, if the design is not suitable for embroidery, breaks section 4, or was priced in error.
  • Our store platform, Shopify, processes payments on our behalf.

3. Samples, production, and delivery

  • After payment we stitch a sample and email you photos. Production starts only after you approve the sample.
  • Your approval confirms the design, including spelling, colors, size, and placement. We are not responsible for errors that were visible in the sample you approved.
  • Lead times on our site are estimates. Shipping time is separate from production time.
  • Embroidery is made with thread on fabric. Small variations in thread shade, stitch texture, and placement between the sample, individual caps, and on-screen previews are normal.

Cancellations, sample revisions, and refunds are covered by our Refund Policy, and delivery by our Shipping Policy.

4. Your designs

  • You keep ownership of the logos and artwork you upload.
  • You confirm you have the right to use them. By uploading, you confirm that you own the design or have permission from its owner, and that it does not infringe anyone's trademark, copyright, or other rights.
  • You give us permission to use them to fill your order. This means reproducing and adapting your design to prepare, sample, and produce your caps, and keeping records of it. We will not use your design in our marketing without your permission.
  • We may refuse designs that appear to infringe others' rights, or that are unlawful, hateful, or obscene.
  • You agree to cover our reasonable costs and liabilities, including legal fees, if a third party brings a claim because a design you supplied infringes their rights.

5. Our site content

The DraftAlive name, site content, images, and design tools belong to us or our licensors. You may not copy or reuse them except to use the site as intended.

6. Warranties

We stand behind our caps as described in our Refund Policy. Apart from that, and to the extent the law allows, the site and products are provided "as is", without other warranties, express or implied, including merchantability or fitness for a particular purpose.

7. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, such as lost profits or event costs. Our total liability for any claim about an order is limited to the amount you paid for that order. Some places do not allow these limits, so they may not fully apply to you.

8. Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable U.S. federal law. Please contact us first so we can try to resolve any issue. If we cannot, disputes will be handled in the state or federal courts located in Collin County, Texas, unless your local consumer law gives you the right to bring a claim elsewhere.

9. Changes

We may update these terms. The version in effect when you place an order applies to that order.
